Man shot and killed at Bull Creek Trade Center
#1
Two men were arguing about Iraq when one was shot and killed this morning at around 9:00. Other details are not too available. There is a story about it on WYMT's web site.

I knew of both of these guys. I have set up with both numerous times. I had never even seen a fight at Bull Creek. I never dreamed something like this would ever happen. What a shame.

Thats a such as sad story. You never hear anything like that happening especially this close to home.
#3
The man who shot him was released with no charges.. it was self defense..
WYMT said they were fighting over the war and troops and Police believe the victim started the fight with the other man before the shooting.
"One witness account stated prior to the shooting, the person that got shot physically assaulted the person who done the shooting prior to the shooting incident," Trooper Scott Hazlette said

PRESTONSBURG - A 65-year-old Floyd County man shot and killed a Clay County man at a flea market yesterday morning during a quarrel over the Iraq war, but no arrest was made, authorities said.

After questioning the suspect, Douglas Moore of Martin, at the Floyd County jail, Kentucky State Police and prosecutors decided Moore acted in self-defense, according to a state police news release.

The victim, Harold W. Smith, 56, of Manchester, and Moore were friends who each had booths at the Bull Creek Trade Center near Prestonsburg.

They began arguing over the war, said Floyd County Coroner Roger Nelson. "I think Doug was supporting it, and this other guy was against it," he said.

Police said the argument escalated into an altercation, and Smith drew a small pistol from his pocket and threatened to kill Moore. Witnesses said Moore pulled a .38-caliber pistol from his pocket and shot Smith once in the chest.

Nelson said he found "a little derringer lying adjacent to Smith's hand where he fell."

Moore was not booked at the county jail, said Floyd Jailer Roger Webb.

State police said that when their investigation is complete, Commonwealth's Attorney Brent Turner will decide whether to present the case to a grand jury.
