With the evolution of so many media outlets I see numerous pictures of high school athletes being used in advertising, even heard talking of new vehicles being loaned/provided for elite area football & basketball players. While talking with a parent last week he ask me if it was legal for businesses to use his kids image in an advertisement without him or his kid being ask for permission.
My question is if an athletes image appears in an advertisement for a business is that athlete allowed to be compensated?

The Kentucky High School Athletic Association released its 2023-24 handbook in July 2023 and student-athletes are now allowed to receive NIL compensation for activations that do not utilize school and association intellectual property.
School can’t organize it or give it out but yes, technically speaking a kid can make some cash off of a billboard advertisement or whatever. Boley at LCA has signed with rocnation already. That’s national. On a local level it can also happen it just hasn’t happened yet in the public eye.

Facebook is flooded with all kinds of popup media that are putting ads on photos taken at sporting events. I would think more sooner than later, some kids or their parents are going to ask for some of the proceeds received from those ads.

Is that not illegal?
no not at allthey can workout before KHSAA approves them to play

I see a lot of post accusing multiple schools of stuff like this and get nobody ever comes out and does anything.
have you contacted the KHSAA with your proof?
Or has any other poster for that matter?

This is exactly what he was talking, about how can a publications use a picture of a kid on an advertisement or vise versa put an ad on a picture of a kid without the parents consent. I know if my daughter were being featured in ads for a car dealer, she better have some wheels or at least a compensation agreement. Families invest thousands to assist a kid in becoming a stay player and they ought to get some help in return when people are using them for a profit. I think it's about to get complicated, coaches & players best be lining up agents for good players if they plan on competing for end of season accolades.
