#1
New information in a shooting investigation in Scott County.

A 19-year-old man now faces charges for accidentally shooting his girlfriend at a home on South Rays Fork Road in Sadieville.

The sheriff's department says Justin Lee Barlow was cleaning his shotgun when it went off hitting the 17-year-old girl in the thigh.

She was air lifted to the UK hospital. A Neighbor told us she's in stable condition. Barlow is charged with wanton endangerment.

I don't see why he would face any charges if it was an accident... I hope the girl recovers soon

They normally do and then take it to the grand jury and see if there is enough for and indictment. And if there is'nt then they normally rule it accidental.

yeah... guess they do that most of the time... once they brought a guy to the jail for shooting and killing somebody but he was never booked or charged with anything because the detectives found it accidental as soon as he walked in... and that was the end of it... and that's not the only one that has been like that either though

It may of been an accident, but who cleans a loaded gun?

That's what I was wondering.

Accidental or not, if he's negligent (which he obviously is), he's guilty of a crime. That's like saying someone who speeds down the road and hits someone and kills them isn't guilty of anything.

what if a shell had gotten stuck in clip, then when he wrenched his gun for cleaning it loaded it up into the chamber unknowing to the boy.. then say he's cleaning around the trigger and accidentaly shoots off a round..

that's if it was a pump shotgun.. i've seen that happen.. but if it was a barrel that you have to break down then yeah the kid should have been more responsible..

Yeah that could of easily happened, but clip-fed shotguns are really rare. Even if he would of wrenched the gun for cleaning it, he would of been cleaning in that area or in the chamber, therefore he would of watched the round being chambered.

Yea but its harder to prove in court than you may think. Also she has to be willing to testify against him, and I would say that she wont.

i didn't mean a clip fed shotgun lol.. i meant the place where the shells are stored.. but i know what you mean.. but then it could have been a semi automatic that had a shell lodged in the holder.. (i'm saying this as meaning that the chamber is the place where the shell goes into just before it's fired). but anyways.. the best thing to do is remember how many shells have been put in and how many have came out..

I doubt this is hard to prove, guns don't just load themselves, point themselves, and fire themselves by themselves

Why does there have to be negligence, if they both say it was an accident then there isnt much you can do iif she refused to proceed with charges.

It might have been an accident, but he was obviously acting carelessly, which would make him negligent

if he was negligent then so was she... she shouldn't have been sitting around while somebody was cleaning a loaded gun

That's like saying someone shouldn't have been standing on a sidewalk when a car swerved off the road, hit them, and killed them.

I doubt everyone in the US cleans their gun alone

that's nothing like saying that... she knew he was cleaning it... they wouldn't know a car was going to come onto the sidewalk

Well I might know a little bit about it since I was in Law Enforcement for 15 years. And its hard to get a conviction, almost impossible if the complaining witness refuses to press charges.

And yes I never cleaned my gun when someone was around, I always waited until I was alone and no one else there.
