LEXINGTON, Ky. â Former disability attorney Eric C. Conn may be in prison, but he is continuing to fight criminal charges against him.
Yesterday, Conn filed a motion seeking to have the original criminal indictment against him dismissed. That indictment charged him with 18 counts â including conspiracy, mail fraud, wire fraud, destruction of records and other charges â related to a scheme to defraud Social Security by obtaining disability benefits for his clients with falsified medical evidence.
Conn ultimately pleaded guilty last year to theft and bribery in exchange for the government dropping those charges, but he fled the country prior to his sentencing.
Conn was sentenced in his absence to the maximum of 12 years, and prosecutors announced their intention to continue prosecution of the original 18 charges because they said he violated his plea agreement by fleeing.
Conn, however, argues that the government cannot enforce parts of a plea agreement, without first giving him a chance to withdraw his plea. Since sentencing proceeded without him, Conn says that means the court accepted the plea agreement as written, and that requires a dismissal of the original 18 counts.
The motion will be considered by U.S. District Judge Danny Reeves, after the prosecution has a chance to respond.
